DLA Piper, TCDI, and The Electronic Discovery Institute (EDI) proudly presented a CLE ethics webinar on “Preservation: Obligations, Best Practices and How to Avoid Potential Pitfalls.”
Preserving potentially relevant information is one of the earliest and most consequential responsibilities in litigation, yet evolving data sources, automated deletion settings, mobile devices, and collaboration platforms continue to make the process increasingly complex. This CLE will examine when the duty to preserve begins, how to identify potentially relevant electronically stored information, and the steps required to implement and manage an effective legal hold.
The program will also explore recent preservation decisions, including common pitfalls that can lead to sanctions or other consequences, as well as practical strategies for working with clients, custodians, and IT teams to create a reasonable and defensible preservation process.
